7. DELIVERY TIMES.
If there is no indication, Our Company shall deliver the goods between 2 and 5 working days without undue delay and no later than 30 days (except for "pre-sales") after the conclusion of the contract. Delivery takes place at the address you indicated when placing the order. Delivery means the transfer to the consumer of physical possession or control of the property. In case of delay in delivery, you can terminate the contract in accordance with the provisions of article L.216-2 of the Consumer Code.
8. TRANSPORT.
8.1 It is advisable to check the condition of the goods before receipt of the goods and signature of the voucherAny risk of loss or damage to property is transferred to you at the time you, or a third party other than the carrier proposed by our Company and designated by you, physically takes possession of the property" (section 216-4 of the Consumer Code).
In case of refusal upon receipt(if the package has been damaged, broken, opened or reconditioned) please send an e-mail tocustomer service@ruedubain.comWithin 3 days of refusal accompanied by photos. Rue du Bain will bring an action against the valet and return the goods to you as soon as possible.
In the event of receipt without verification, we invite you to immediately check the contents of the package, if a product proves to be damaged or missing from the list of the preparation voucher, we advise you to submit article L224-65 of the Consumer Code (send a recommended to the carrier):Where the consumer personally takes delivery of the goods carried and the valet does not justify giving him the opportunity to check their good condition, the period referred to in the'article L. 133-3 of the Commercial CodeWhich extinguishes any action against the valet is increased to ten days.
8.2 Addressing error:
In the event that the postal delivery address is incorrect (missing information, incorrect information, city indicated not corresponding to the postal code, customer name not present on the delivery letter box...), the company RUE DU BAIN is not responsible for the non-delivery of the order. The words "At Mr and Mrs...", postal code and other information must be filled in in the fields intended for the address in order to be taken into account for the shipment, not in the "Comment" insert. The company RUE DU BAIN, however, will propose to the customer to wait a period of 20 to 30 days for a possible return of the parcel by the transport services in order to make a return of the order to the customer's responsibility to the correct address. Any changes in destination address must be reported to our VAS before shipment to be taken into account.

10. RETRACTATION.
10.1 Approach
Under the conditions laid down in articles L221-18 and in accordance with the Consumer Code you have a withdrawal period of 14 days from the date of issue of the property.
For orders for several goods delivered separately, the withdrawal period shall run from the day on which the buyer, or a third party other than the carrier and designated by him, takes physical possession of the last property.
To exercise the right of withdrawal, we must notify you to Our Company by e-mail tocustomer service@ruedubain.comWith the withdrawal form available at the end of the GTC (Annex 1).
Return
The item must be properly protected, in its original packaging WITHOUT mark of writing and filmed on pallet or protected in a second carton accompanied by all accessories without mark of wear or use.
In order to ensure better traceability of the return, the returned product(s) must be accompanied by the withdrawal form available at the end of the GTC (Appendix 1).
The cost of shipping your goods, as part of this withdrawal request, is at your expense.
Return can be organized in two ways:
- By your own means: The customer will ship the items by his own means to the following address: RUE DU BAIN 6 Boulevard Carnot 12400 Saint Affrique. Due to the nature of the items ONLY the taps or bonds may be returned by the Post Office. Other items will be shipped by a carrier or courier company of your choice (in accordance with the nature of the items).
- By our company: The customer should contact the customer service atcustomer service@ruedubain.com or 0565494476 to apply. The return fee will be sent by e-mail for customer validation. In this case the return costs will be deducted from the refund of your order.
Return fees are indexed to the amount of your order:
- 15 € up to 109 €
- 20 € from 109 to 189 €
- 45 € from 189 to 429 €
- 90 € beyond 429 €
As of the notice of withdrawal, you have 14 days to return the goods to the following address: RUE DU BAIN 6 Boulevard Carnot 12400 Saint Affrique - France.
The buyer may be liable in the event of depreciation of the goods resulting from manipulations other than those necessary to establish the nature, characteristics and proper functioning of the goods. In the event of withdrawal from the buyer, Our Company shall reimburse him for all payments received from him NOT including delivery costs. Our Company makes the refund within 14 days of receipt of the item(s) using the same means of payment as used for the initial transaction, unless the buyer expressly agrees to use a different means.
The right of withdrawal may not be exercised, in the cases provided for in Article L221-28 of the Consumer Code, in particular in respect of: - the supply of goods manufactured according to the consumer's specifications or clearly personalized, such as parts assembled at the buyer's request; - products which, because of their nature, cannot be shipped back or are likely to deteriorate.
For any non-compliant return a package fordefault packaging of 20 € will be deducted from your refund.

Legal guarantee of compliance / Guarantee of hidden defects.
The manufacturer's or Our Company's commercial guarantee shall not preclude the legal guarantee of conformity referred to in articles L. 217-4 to L. 217-12 of the Consumer Code and that relating to defects of the thing sold, under the conditions laid down in articles 1641 to 1648 of the Civil Code. Legal Guarantee of Compliance (Consumer Code) Article L217-4: The seller delivers goods in accordance with the contract and responds to any defects in conformity existing at the time of issue.
When you act as a legal guarantee of compliance, you:
- Enjoy a period of 2 years from the issue of the property to act (Article L217-7 of the Consumer Code)
- Can choose between repair, replacement of the property (by identical or equivalent) or reimbursement (only if item no longer in stock or is delisted), subject to certain cost conditions provided for in article L.217-9 of the Consumer Code.
The legal guarantee of conformity shall apply irrespective of the commercial guarantee or any manufacturer guarantee granted.
Legal warranty of hidden defects on products sold:
You can decide to implement the legal guarantee against hidden defects of the intended sold thing (article 1641 of the Civil Code). In this case, you can choose between the resolution of the sale or a reduction in the sale price (article 1644 of the Civil Code).
For all requests for guarantees (compliance or hidden vice), you will be asked to provide us by e-mail tocontact@ruedubain.com, your order number as well as photos of the problem encountered in order to manage your folder.
Article L217-5: The property complies with the contract:
1° If it is specific to the usually expected use of a similar property and, if applicable:
- if it corresponds to the description given by the seller and has the qualities that it has presented to the buyer in the form of a sample or model ;
- if it presents the qualities that a buyer can legitimately wait with regard to the public statements made by the seller, the producer or its representative, especially in advertising or labelling ;
2° Or if it presents the characteristics defined by mutual agreement by the parties or is specific to any special use sought by the buyer, brought to the knowledge of the seller and that the seller has accepted.
Article L217-12: The action resulting from non-conformity is prescribed by two years from the date of issue of the property.
Legal guarantee of hidden defects on products sold (Civil Code)
Article 1641: The seller is bound by the guarantee because of the hidden defects of the thing sold which make it unfit for use to which it is intended, or which reduce such use, that the buyer would not have acquired it, or would have given only a lesser price, had he known them.
Article 1644: In the case of articles 1641 and 1643, the buyer has the choice of returning the thing and getting the price returned, or keeping the thing and getting a part of the price returned. Article 1648, paragraph 1: The action resulting from rectibitory defects shall be brought by the acquirer within two years of the discovery of the defect.
Return for compliance guarantee / hidden vice:
The customer therefore undertakes to return the product to the company Rue du Bain so that it can pass an expert opinion in order to determine the conformity or hidden defect of the product. The cost of returning the product is borne by the customer. In the application of the warranty, the shipping costs will be reimbursed to the customer.
