Applicable to consumers

1. IDENTITY OF THE SELLER:

SAS RUE DU BAIN (Notre Société), owner of the site https://www.ruedubain.com/en/, is S.A. management board and supervisory board with a share capital of EUR 1 000 whose registered office is located 6 Boulevard Carnot 12400 Saint Affrique (Telephone No + 33 (0)5.65.49.44.76), registered in the Register of Commerce and Companies of Rodez under the number 537 667 578 (VAT: FR 28 537 667 578).

2. APPLICATION OF CONDITIONS.

These General Conditions of Sale (GTC) apply to all sales with consumers on the site. You agree that the information requested for the conclusion of the contract or that sent in the course of its execution should be transmitted electronically. The General Terms and Conditions may be modified at any time without notice by Our Company, the amendments being applicable to all subsequent orders. The applicable GTCs are those in force on the day of the order.

3. ORDERS.

The essential characteristics of the product are indicated in the Product Sheet. Our Company can update, improve its records, withdraw from the sale of the products. The duration of availability on the market of spare parts necessary for the use of the property shall be communicated when notified by the manufacturer. It is up to you to inform the local authority of your country of any restrictions on the import or use of the products or services you plan to order. Any abnormal or bad faith order, fraud or attempted fraud, any incident of payment of the price of an order may result in the deletion and/or deactivation of the customer account concerned and/or the refusal of the order. Rue du Bain reserves the right to cancel an order following a technical, tariff or other problem.

4. STEPS TO CONCLUDE THE CONTRACT.

When ordering first over the Internet, any new customer must create a "Customer Account"; a login and a password of at least five alphanumeric characters will be requested. During each order validation, you will be directed to your account via a secure connection recalling the content of your order. Your order may be changed at any time before its final validation. It will only be definitively registered after information and final validation. The order placed on our site is automatically cancelled if no payment is received. French is the only language proposed for the conclusion of the contract. Our Company stores purchase orders and invoices on its servers. The consideration of your order is confirmed by sending an email generated automatically by our website to the email address indicated when creating the customer account.

5. PRICES.

The prices on the website are shown in euros, including VAT, excluding shipping costs. The amount of the delivery costs is calculated automatically according to each order (metropolitan France, France-Corse, Belgium, Luxembourg), it appears on the summary of your order, before final registration. For deliveries outside the French territory, please contact customer service at customer service@ruedubain.com to determine transportation costs.

The provisions of the General Tax Code relating to VAT shall apply. Any order delivered outside metropolitan France may be subject to any local taxes, customs duties, sea grants and customs clearance fees upon delivery. Their acquittal is your responsibility. Contact the competent authorities of the country of delivery.

6. PAYMENT.

Any settlement paid to Our Society cannot be considered as a deposit. The methods of payment accepted are indicated in particular on the "Methods of payment" page of the website. You may never, on the basis of a claim, withhold all or part of the amounts due from it or make compensation. As a result of a delay in payment or partial payment of a due date at its end, Our Company may, without prior notice, immediately suspend deliveries without the possibility of claiming damages. As part of the fight against fraud, Our Company can ask you to justify your identity, your home, and the means of payment used. In this case, the processing of your order will take place on receipt of these documents. In the absence of receipt of such evidence or in the event of receipt of evidence found to be non-compliant, the order may be cancelled and the account blocked.

7. DELIVERY TIMES.

If there is no indication, Our Company shall deliver the goods between 2 and 5 working days without undue delay and no later than 30 days (except for "pre-sales") after the conclusion of the contract. Delivery takes place at the address you indicated when placing the order. Delivery means the transfer to the consumer of physical possession or control of the property. In case of delay in delivery, you can terminate the contract in accordance with the provisions of article L.216-2 of the Consumer Code.

8. TRANSPORT.

8.1 It is advisable to check the condition of the goods before receipt of the goods and signature of the voucherAny risk of loss or damage to property is transferred to you at the time you, or a third party other than the carrier proposed by our Company and designated by you, physically takes possession of the property" (section 216-4 of the Consumer Code).

In case of refusal upon receipt (if the package has been damaged, broken, opened or reconditioned) please send an e-mail to customer service@ruedubain.com within 3 days of refusal accompanied by photos. Rue du Bain will bring an action against the valet and return the goods to you as soon as possible.

In the event of receipt without verification, we invite you to immediately check the contents of the package, if a product proves to be damaged or missing from the list of the preparation voucher, we advise you to submit article L224-65 of the Consumer Code (send a recommended to the carrier): Where the consumer personally takes delivery of the goods carried and the valet does not justify giving him the opportunity to check their good condition, the period referred to in the'article L. 133-3 of the Commercial CodeWhich extinguishes any action against the valet is increased to ten days.

8.2 Addressing error:
In the event that the postal delivery address is incorrect (missing information, incorrect information, city indicated not corresponding to the postal code, customer name not present on the delivery letter box...), the company RUE DU BAIN is not responsible for the non-delivery of the order. The words "At Mr and Mrs...", postal code and other information must be filled in in the fields intended for the address in order to be taken into account for the shipment, not in the "Comment" insert. The company RUE DU BAIN, however, will propose to the customer to wait a period of 20 to 30 days for a possible return of the parcel by the transport services in order to make a return of the order to the customer's responsibility to the correct address. Any changes in destination address must be reported to our VAS before shipment to be taken into account.

10. RETRACTATION.

10.1 Approach

Under the conditions laid down in articles L221-18 and in accordance with the Consumer Code you have a withdrawal period of 14 days from the date of issue of the property.

For orders for several goods delivered separately, the withdrawal period shall run from the day on which the buyer, or a third party other than the carrier and designated by him, takes physical possession of the last property.

To exercise the right of withdrawal, we must notify you to Our Company by e-mail to customer service@ruedubain.com with the withdrawal form available at the end of the GTC (Annex 1).

Return

The item must be properly protected, in its original packaging WITHOUT mark of writing and filmed on pallet or protected in a second carton accompanied by all accessories without mark of wear or use.

In order to ensure better traceability of the return, the returned product(s) must be accompanied by the withdrawal form available at the end of the GTC (Appendix 1).

The cost of shipping your goods, as part of this withdrawal request, is at your expense.

Return can be organized in two ways:

-By your own means: The customer will ship the items by his own means to the following address: RUE DU BAIN 6 Boulevard Carnot 12400 Saint Affrique. Due to the nature of the items ONLY the taps or bonds may be returned by the Post Office. Other items will be shipped by a carrier or courier company of your choice (in accordance with the nature of the items).

-By our company: The customer should contact the customer service at customer service@ruedubain.com or 0565494476 to apply. An estimate of the return fee will be made and sent by e-mail for customer validation. In this case the return costs will be deducted from the refund of your order.

As of the notice of withdrawal, you have 14 days to return the goods to the following address: RUE DU BAIN 6 Boulevard Carnot 12400 Saint Affrique - France.

The buyer may be liable in the event of depreciation of the goods resulting from manipulations other than those necessary to establish the nature, characteristics and proper functioning of the goods. In the event of withdrawal from the buyer, Our Company shall reimburse him for all payments received from him NOT including delivery costs. Our Company makes the refund within 14 days of receipt of the item(s) using the same means of payment as used for the initial transaction, unless the buyer expressly agrees to use a different means.

The right of withdrawal may not be exercised, in the cases provided for in Article L221-28 of the Consumer Code, in particular in respect of: - the supply of goods manufactured according to the consumer's specifications or clearly personalized, such as parts assembled at the buyer's request; - products which, because of their nature, cannot be shipped back or are likely to deteriorate.

For any non-compliant return a package fordefault packaging of 20 € will be deducted from your refund.

11. GUARANTEE.

Legal guarantee of compliance / Guarantee of hidden defects.

The manufacturer's or Our Company's commercial guarantee shall not preclude the legal guarantee of conformity referred to in articles L. 217-4 to L. 217-12 of the Consumer Code and that relating to defects of the thing sold, under the conditions laid down in articles 1641 to 1648 of the Civil Code. Legal Guarantee of Compliance (Consumer Code) Article L217-4: The seller delivers goods in accordance with the contract and responds to any defects in conformity existing at the time of issue.

When you act as a legal guarantee of compliance, you:

- Enjoy a period of 2 years from the issue of the property to act (Article L217-7 of the Consumer Code)

- Can choose between repair (excluding labour), replacement of the property (by identical or equivalent) or reimbursement (only if the item is no longer in stock or is delisted), subject to certain cost conditions provided for in article L.217-9 of the Consumer Code.

The legal guarantee of conformity shall apply irrespective of the commercial guarantee or any manufacturer guarantee granted.

Legal warranty of hidden defects on products sold:

You can decide to implement the legal guarantee against hidden defects of the intended sold thing (article 1641 of the Civil Code). In this case, you can choose between the resolution of the sale or a reduction in the sale price (article 1644 of the Civil Code).

For all requests for guarantees (compliance or hidden vice), you will be asked to provide us by e-mail to contact@ruedubain.com, your order number as well as photos of the problem encountered in order to manage your folder.

Article L217-5: The property complies with the contract:

1° If it is specific to the usually expected use of a similar property and, if applicable:

- if it corresponds to the description given by the seller and has the qualities that it has presented to the buyer in the form of a sample or model ;

- if it presents the qualities that a buyer can legitimately wait with regard to the public statements made by the seller, the producer or its representative, especially in advertising or labelling ;

2° Or if it presents the characteristics defined by mutual agreement by the parties or is specific to any special use sought by the buyer, brought to the knowledge of the seller and that the seller has accepted.

Article L217-12: The action resulting from non-conformity is prescribed by two years from the date of issue of the property.

Legal guarantee of hidden defects on products sold (Civil Code)

Article 1641: The seller is bound by the guarantee because of the hidden defects of the thing sold which make it unfit for use to which it is intended, or which reduce such use, that the buyer would not have acquired it, or would have given only a lesser price, had he known them.

Article 1644: In the case of articles 1641 and 1643, the buyer has the choice of returning the thing and getting the price returned, or keeping the thing and getting a part of the price returned. Article 1648, paragraph 1: The action resulting from rectibitory defects shall be brought by the acquirer within two years of the discovery of the defect.

The photos and colours presented on the site are informative and non-contractual and cannot be held responsible by SAS Rue du Bain.

Return for compliance guarantee / hidden vice:

The customer therefore undertakes to return the product to the company Rue du Bain so that it can pass an expert opinion in order to determine the conformity or hidden defect of the product. The cost of returning the product is borne by the customer. In the application of the warranty, the shipping costs will be reimbursed to the customer.

12. PROPERTY RESERVE.

The goods that will be delivered and invoiced will remain the property of Our Company until full payment of their price. Failure to pay the sum in full may result in the claim of the goods by Our Company, the restitution being immediate and the goods delivered at your expense, risks and perils. During the period of delivery to the transfer of ownership, the risk of loss, theft or destruction, as well as any damage you may cause, remains at your expense.

13. INFORMATION AND FREEDOMS.

Our Company collects information about you when creating your Customer Account. This information enables us to carry out, inter alia, operations relating to the management of customers, prospecting, the preparation of commercial statistics, the management of applications for access, rectification and opposition rights, the management of unpaid payments and litigation, the management of promotional transactions, the management of notices. These data can be used to send promotional information and offers from Rue du Bain, which you can unsubscribe from at any time by unchecking the My Account / Manage my Newsletter subscriptions page option. The legal basis for such data processing is the execution of these General Terms and Conditions. Prospecting for similar goods and products is based on the legitimate interest of our Company. Other prospecting operations are based on your consent. The recipients of your data are the services of our Society and legal auxiliaries legally entitled to receive their communication. Your data will only be kept for the time necessary to achieve the above-mentioned purposes, and in accordance with the applicable legal conservation rules in commercial matters. In accordance with the provisions of the Data Protection Act of 6 January 1978 (amended) and the General Data Protection Regulation, you have the right to access, rectify, portability and erasure of your personal data. You can also request the limitation of the processing of your data. Your application must specify your surname(s), first name(s), customer number and include a copy of your ID. You may also, for legitimate reasons, object to the processing of your data and have the right to withdraw your consent at any time when the processing of personal data is based on it. Finally, you have the possibility to lodge a complaint with the supervisory authorities responsible for the protection of personal data.

14. FINAL STIPULATIONS.

Our Company will archive purchase orders and invoices on a reliable and durable medium constituting a true copy in accordance with the provisions of article 1348 of the Civil Code. Our Company's computerized records will be considered by the parties as evidence of communications, orders, payments and transactions between the parties, unless proven otherwise. French law is applicable without excluding the application of the mandatory legislative rights granted to consumers or of a more protective mandatory law by the foreign court seised by a consumer in the corresponding country. If any of the terms or provisions of these Terms and Conditions were to be annulled or declared unlawful by a final court decision, such nullity or illegality shall in no way affect the other terms and provisions, which shall continue to apply.

15. MEDIATION

In accordance with the provisions of the Consumer Code concerning the amicable settlement of disputes, Our Company adheres to the Service of the Ombudsman CNPM - CONSUMER MEDIATION with the following coordinates: 23, rue Terrenoire - 42100 SAINT ETIENNE – https://www.cnpm-mediation-consommation.eu/. After prior written action by consumers vis-à-vis Notre Société, the Ombudsman's Office may be seized of any consumer dispute which has not been settled. The consumer is also informed of the existence of the online platform set up by the European Commission, which aims to collect any complaints arising from an online purchase by European consumers and then transmit the cases received to the competent national mediators: http://ec.europa.eu/consumers/odr/. Our Company adheres to the CNPM whose codes of conduct are available on their site. The fact that Our Company does not avail itself at any time of any of the provisions of this Agreement shall not be construed as a waiver of any subsequent use of such clauses.

16. LEGAL ATTRIBUTION

Where the customer is a professional, any dispute arising in connection with the interpretation, the conclusion or execution of these General Terms and Conditions of Sale shall be subject to the jurisdiction of the Millau Commercial Court. This provision does not apply in the event of a dispute with an individual for whom the legal rules of jurisdiction apply.
